I've failed a post race and lost a win. Yep that sucks. But skipping it altogether. . .for me it is cut and dry: whatever is the most egregious violation that could be present but then corrected by not allowing immediate post race tech would be the assumed penalty. If the driver denies access to the car, tech must assume the worst every time.

And yes IMO you have plenty of teams on tight budgets who could step over that line just trying to make the field against unlimited budget cars. You get an upset every now and then and they pull off a win and there you are. Probably earned the win with grit and grease but forced to just drive away.
